Terms of Service

1. Agreement

By using Provenience, you agree to these terms. If you do not agree, do not use the Service.

2. Description of Service

Provenience is a data and integration platform for businesses that run on human communication. It ingests data from the tools a business already uses, organizes it around projects and customers, and exposes it to AI tools through a secure interface, on a subscription basis.

3. Eligibility

You must be 18 or older and have the authority to enter into these terms, either for yourself or on behalf of the business you represent.

4. Accounts

You are responsible for protecting your account credentials and for all activity under your account. Contact zane@bluedataworks.com if you suspect unauthorized access. You may not share your account or use the Service on behalf of a business other than the one your account belongs to.

5. Acceptable Use

You may not use the Service for unlawful purposes, to manipulate or attack the platform, to generate harmful content through its AI tools, to bypass access controls, to resell access, or to enter another person's data without their consent.

6. Billing & Payment

Pricing and billing terms are set out at signup and billed on a subscription basis. Payments are non-refundable except as required by law or at our sole discretion.

7. Your Data

You own the business data you provide to Provenience. We retain only the limited rights needed to operate the Service on your behalf. We do not sell your data or use it to train AI models.

8. AI-Generated Content

Provenience uses Claude, from Anthropic, to process and organize data and to power its AI tools. You are responsible for reviewing AI-generated output before relying on it or sharing it with your customers.

9. Intellectual Property

Provenience owns all software, design, and branding associated with the Service, with standard intellectual property protections.

10. Disclaimers

The Service is provided without warranties of any kind regarding performance, reliability, or freedom from defects.

11. Limitation of Liability

Our liability is limited to the amount you paid in the preceding 12 months, or $50, whichever is greater, excluding consequential damages, to the extent permitted by law.

12. Termination

You may close your account by contacting zane@bluedataworks.com. We may suspend or terminate your account for violations of these terms or non-payment, with notice where practical.

13. Governing Law

These terms are governed by the laws of the State of Texas, and disputes are resolved in Texas courts.

14. Changes to These Terms

We will notify you by email of material changes. Continued use of the Service after a change takes effect means you accept it.

15. SMS Terms & Conditions

Program description. Provenience sends transactional SMS notifications to opted-in users about account and platform activity.

Opt-in. You enable SMS notifications in your account settings. Consent is not a condition of purchasing or using any Provenience service.

Message frequency. Messages are sent based on account activity and may vary.

Message and data rates. Standard carrier message and data rates may apply. Provenience does not charge separately for SMS.

Opt-out. Reply STOP to any message, or disable SMS notifications in your account settings, at any time. You may opt back in at any time.

Help. Reply HELP to any message, or email zane@bluedataworks.com.

Supported carriers. AT&T, Verizon, T-Mobile, Boost Mobile, and MetroPCS are supported. Carrier delivery is not guaranteed.

SMS privacy. Phone numbers collected for SMS notifications are used only for that purpose and are not shared with third parties for marketing.
